Message frequency may vary based on your communication needs. On average, you may receive 1–5 messages per month during active communication or service periods. Message and data rates may apply.

SMS Messaging Service

By providing your phone number and opting in, you consent to receive SMS text messages from Lightfoot Publishing LLC for the following purposes:

Customer Service Communications: Conversational messages about inquiries, book orders, publishing-related services, speaking requests, event coordination, and general customer support.

Publishing Services Communications: Messages related to publishing services, book projects, applied resources, author-related services, and service follow-ups.

Speaking and Event Communications: Messages related to private and public speaking engagements, book-related events, scheduling, event coordination, and related logistics.

Since our messages are conversational and related to publishing services, speaking engagements, training, events, and customer service, we cannot provide an exact frequency estimate. You may receive multiple messages during active scheduling, service coordination, or event planning, or you may go extended periods without receiving messages when no active communication is needed.

Lightfoot Publishing LLC reserves the right to alter the frequency of messages at any time based on your service or communication needs. Lightfoot Publishing LLC and mobile carriers are not liable for delays or undelivered messages.

Message and Data Rates

Message and data rates may apply based on your mobile carrier’s pricing plan. Lightfoot Publishing LLC does not charge for SMS messages, but your carrier may charge you for sending and receiving text messages. Please check with your mobile carrier for details about your messaging plan and any applicable charges.

Liability and Service Limitations

Lightfoot Publishing LLC is not responsible for any charges, errors, or delays in SMS delivery caused by your mobile carrier or third-party service providers. Factors that may affect message delivery include but are not limited to:

 

Mobile carrier network issues or outages
Device compatibility or technical limitations
Signal strength or connectivity problems
Carrier filtering or blocking of messages
Device storage limitations
Third-party service provider issues

While we make reasonable efforts to ensure timely delivery of SMS messages, we cannot guarantee that all messages will be delivered or delivered within any specific timeframe. Lightfoot Publishing LLC and mobile carriers are not liable for delayed, undelivered, or incorrectly delivered messages.

Consent and Authorization

By opting in to receive SMS messages from Lightfoot Publishing LLC, you represent and warrant that:

You are the authorized user of the mobile phone number you have provided.
You are at least 18 years of age.
You have the authority to agree to these Terms.
The phone number you provided is accurate and currently active.
You understand that consent to receive SMS messages is not a condition of purchase or use of Lightfoot Publishing LLC services.

Governing Law

These Terms are governed by the laws of the State of New Mexico, without regard to its conflict-of-law provisions. Any dispute arising from or relating to these Terms, the website, SMS messaging, purchases, services, or related transactions shall be handled in accordance with the Dispute Resolution and Arbitration section of these Terms, unless otherwise required by applicable law.

Dispute Resolution and Arbitration

To the extent permitted by applicable law, any dispute, claim, or controversy arising out of or relating to these Terms, your use of this website, purchases from Lightfoot Publishing LLC, publishing services, speaking services, training services, digital products, customer service communications, refund requests, SMS messaging, or any related transaction or service shall first be addressed through a good-faith effort to resolve the matter informally.

 

Before filing any arbitration, lawsuit, chargeback, payment dispute, or formal claim, you agree to contact Lightfoot Publishing LLC at info@lightfp.com or 888-477-9314 and provide a written description of the dispute, the relief requested, and any supporting documentation. Lightfoot Publishing LLC will make reasonable efforts to review and respond to the dispute.

 

If the dispute cannot be resolved informally, you and Lightfoot Publishing LLC agree that the dispute shall be resolved by binding arbitration, rather than in court, except for claims that may be brought in small claims court or claims that cannot be required to be arbitrated under applicable law. The arbitration shall be administered by the American Arbitration Association (“AAA”) under its applicable Consumer Arbitration Rules or Commercial Arbitration Rules, depending on the nature of the dispute and the parties involved.

 

You and Lightfoot Publishing LLC agree that arbitration will be conducted on an individual basis only. You and Lightfoot Publishing LLC waive the right to participate in a class action, class arbitration, collective action, representative action, or consolidated proceeding, to the extent permitted by applicable law.

 

You and Lightfoot Publishing LLC also waive the right to a jury trial for disputes subject to arbitration, to the extent permitted by applicable law. The arbitrator shall have authority to award the same individual relief that a court could award, subject to the limitations stated in these Terms and applicable law.

 

Unless otherwise required by applicable law or AAA rules, the arbitration shall take place in New Mexico, by telephone, by video conference, by written submissions, or in another manner approved by the arbitrator. The arbitrator’s decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

 

Nothing in this section prevents either party from bringing an eligible claim in small claims court. Nothing in this section prevents either party from seeking temporary or emergency injunctive relief in court when necessary to protect intellectual property, confidential information, business operations, data security, or other rights that may be harmed before arbitration can be completed.

 

These Terms are governed by the laws of the State of New Mexico, without regard to conflict-of-law principles. The agreement to arbitrate shall be governed by the Federal Arbitration Act, where applicable, and by the New Mexico Uniform Arbitration Act to the extent applicable and not inconsistent with federal law.

 

This arbitration provision shall survive termination of your use of the website, completion of a purchase, cancellation of services, opt-out from SMS messaging, or any other end of your relationship with Lightfoot Publishing LLC.

Severability

If any provision of these Terms is found to be unenforceable or invalid under any applicable law, that unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole. Such provisions shall be deleted without affecting the remaining provisions.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Lightfoot Publishing LLC regarding the SMS messaging service and supersede all prior or contemporaneous communications and proposals, whether oral or written, between you and Lightfoot Publishing LLC.
